TERMS OF USE FOR PARTICIPANTS

SECTION 1
 
Introduction

1.1 These Terms of Use ("Terms") govern your access to and use of websites, applications, entry systems, registration services, results services and related services provided by Sublime Timing Ltd, Sublime Racing Ltd and their associated brands (collectively referred to as "Sublime Timing", "we", "our" or "us").

1.2 By accessing, browsing, registering with or using our services, you agree to be bound by these Terms.

1.3 If you do not agree to these Terms, you must not use our services.

 
SECTION 2
 
About Us

2.1 Sublime Timing Ltd and Sublime Racing Ltd provide event registration, event administration, timing services, results services, communications services and related event support services.

2.2 In most cases Sublime Timing acts as a service provider to independent Event Organisers.

2.3 Unless expressly stated otherwise, Sublime Timing is not the organiser, promoter or operator of events listed on its platform.

 
SECTION 3
 
Acceptance of Terms

3.1 By using our services you confirm that:

(a) you have read and understood these Terms;

(b) you agree to be legally bound by these Terms;

(c) all information you provide is accurate and complete;

(d) you have the legal capacity to enter into these Terms.

3.2 If you register, enter or make a booking on behalf of another person, you confirm that you have authority to do so and that you have provided these Terms and any applicable event terms to that person.

 
SECTION 4
 
Eligibility and Junior Participants

4.1 You must be at least 18 years of age to create an account or enter into a contract using our services.

4.2 Participants under the age of 18 may be entered into events where permitted by the relevant Event Organiser.

4.3 Any entry submitted on behalf of a participant under the age of 18 must be completed by a parent, legal guardian or other person with lawful authority to act on behalf of that participant.

4.4 The person submitting such an entry confirms that:

(a) they have authority to act on behalf of the participant;

(b) they consent to the collection and processing of the participant's information;

(c) they accept these Terms on behalf of the participant;

(d) they accept any event specific terms on behalf of the participant.

 
SECTION 5
 
Accounts and Registration

5.1 Certain services may require you to create an account.

5.2 You are responsible for maintaining the confidentiality of your login credentials.

5.3 You are responsible for all activity conducted through your account.

5.4 You must notify us immediately if you believe your account has been accessed without authorisation.

5.5 We reserve the right to suspend or terminate accounts where:

(a) inaccurate information is supplied;

(b) these Terms are breached;

(c) fraudulent activity is suspected;

(d) use of the account may expose us, Event Organisers or participants to risk.

5.6 We may suspend or terminate accounts without notice where reasonably necessary to protect the security, integrity or operation of our services.

 
SECTION 6
 
Event Entries

6.1 Events listed on our platform are generally organised by independent Event Organisers.

6.2 Event Organisers are responsible for:

(a) organising and delivering the event;

(b) event safety;

(c) risk assessments;

(d) route design;

(e) permits and permissions;

(f) event rules;

(g) participant eligibility;

(h) event cancellation decisions;

(i) refund, transfer and deferral policies.

6.3 By submitting an entry you agree to:

(a) provide accurate information;

(b) comply with these Terms;

(c) comply with the Event Organiser's terms and conditions;

(d) comply with all event rules and instructions.

6.4 Submission of an entry request does not guarantee acceptance into an event.

6.5 Entry acceptance remains subject to confirmation by the Event Organiser.

 
SECTION 7
 
Payments

7.1 Entry fees, booking fees, payment processing fees and other charges will be displayed during the registration process.

7.2 By submitting payment details you confirm that you are authorised to use the payment method provided.

7.3 Payment must be successfully processed before an entry can be confirmed.

7.4 We reserve the right to refuse, cancel or reverse transactions where:

(a) payment cannot be verified;

(b) fraudulent activity is suspected;

(c) an error has occurred in pricing or event information;

(d) required information has not been provided.

7.5 Confirmation of payment does not override any eligibility requirements imposed by the Event Organiser.

 
SECTION 8
 
Refunds, Transfers and Deferrals

8.1 Refund, transfer and deferral policies are determined by the relevant Event Organiser unless expressly stated otherwise.

8.2 Participants should review event specific terms before entering.

8.3 Where Sublime Timing processes refunds, transfers or deferrals on behalf of an Event Organiser, such actions shall be carried out in accordance with the Event Organiser's instructions and policies.

8.4 Booking fees, payment processing fees and administrative fees may be non refundable where permitted by law.

 
SECTION 9
 
Event Information

9.1 Event information is supplied by Event Organisers.

9.2 While we may assist with publishing event information, we do not guarantee its accuracy, completeness or suitability.

9.3 Participants should direct event specific questions to the relevant Event Organiser.

9.4 Event dates, locations, routes, schedules, start times and event details may change.

9.5 Participants are responsible for checking event information prior to attending an event.

 
SECTION 10
 
Participant Responsibilities

10.1 Participants are solely responsible for determining whether they are physically and medically capable of participating in an event.

10.2 Participants must comply with:

(a) all event rules;

(b) all instructions issued by the Event Organiser;

(c) all instructions issued by event officials, marshals, medical personnel and authorised event representatives;

(d) any applicable governing body rules.

10.3 Participants acknowledge that participation in sporting and endurance events may involve inherent risks including, but not limited to:

(a) illness;

(b) injury;

(c) disability;

(d) property damage;

(e) death.

10.4 Participants participate entirely at their own risk.

10.5 Nothing within these Terms excludes any liability that cannot legally be excluded under applicable law.

 
SECTION 11
 
Results and Public Information

11.1 Participants acknowledge that event administration requires the publication of certain information relating to entries and results.

11.2 By entering an event through our platform, participants acknowledge and agree that information may be published in:

(a) start lists;

(b) participant lists;

(c) live tracking systems;

(d) provisional results;

(e) final results;

(f) rankings;

(g) team results;

(h) event reports.

11.3 Published information may include:

(a) participant name;

(b) club or organisation;

(c) age category;

(d) race number;

(e) event category;

(f) position;

(g) finish time;

(h) split times;

(i) team information;

(j) other event related performance information.

11.4 Results may be published on websites, mobile applications, social media platforms, public displays, timing screens, printed materials and third party results services.

11.5 Participants acknowledge that public results are a fundamental part of competitive sporting events and event administration.

11.6 Results are provided based on information available at the time and may be subject to review, correction, amendment, recalculation or republication.

11.7 No timing, registration or results system can be guaranteed to be completely free from errors, omissions, missed detections, technical issues or subsequent amendments.

11.8 We reserve the right to amend, correct or republish results where additional information becomes available or corrections are considered necessary.

 
SECTION 12
 
Personal Data and Privacy

12.1 We process personal data in accordance with:

(a) the UK General Data Protection Regulation;

(b) the Data Protection Act 2018;

(c) our Privacy Policy.

12.2 Personal information may be collected for purposes including:

(a) event registration;

(b) participant administration;

(c) timing services;

(d) results publication;

(e) communications relating to events;

(f) customer support;

(g) fraud prevention;

(h) legal and regulatory compliance.

12.3 Information may be shared with:

(a) Event Organisers;

(b) governing bodies;

(c) timing providers;

(d) fulfilment providers;

(e) payment providers;

(f) insurers;

(g) emergency services;

(h) regulatory authorities;

(i) other service providers involved in delivering event services.

12.4 We will not sell personal data to third parties.

12.5 Further information regarding data processing is contained within our Privacy Policy.

 
SECTION 13
 
User Content

13.1 Participants may have the ability to submit reviews, comments, messages, photographs, videos or other content.

13.2 Participants remain responsible for all content submitted by them.

13.3 Content submitted by participants must:

(a) be lawful;

(b) be accurate;

(c) not infringe the rights of any third party;

(d) not be abusive, threatening, defamatory, discriminatory, offensive or misleading.

13.4 By submitting content through our services, participants grant us a non exclusive, worldwide, royalty free licence to use, reproduce, publish and display that content for purposes connected with the operation, promotion and administration of our services and events.

13.5 We reserve the right to remove content at our discretion.

 
SECTION 14
 
Acceptable Use

14.1 Participants must not:

(a) use our services for unlawful purposes;

(b) attempt to gain unauthorised access to systems or accounts;

(c) introduce viruses, malware or harmful code;

(d) interfere with the operation of our services;

(e) use automated tools to scrape or harvest data;

(f) impersonate another person;

(g) provide false or misleading information;

(h) use our services in a manner likely to damage our reputation or the reputation of an Event Organiser.

14.2 We reserve the right to suspend or terminate access where these provisions are breached.

 
SECTION 15
 
Intellectual Property

15.1 All intellectual property rights relating to our websites, services, branding, content, software, databases, designs, graphics and materials remain the property of Sublime Timing, Sublime Racing or their licensors.

15.2 Participants are granted a limited, non transferable licence to access and use our services for personal, non commercial purposes.

15.3 Participants must not copy, reproduce, distribute, modify, reverse engineer or commercially exploit any part of our services without prior written permission.

 
SECTION 16
 
Third Party Services and Links

16.1 Our services may contain links to third party websites, applications or services.

16.2 We are not responsible for the content, availability, accuracy or operation of third party services.

16.3 Use of third party services is entirely at the participant's own risk.

 
SECTION 17
 
Website Availability

17.1 We aim to provide reliable access to our services but do not guarantee uninterrupted availability.

17.2 We may suspend, modify, withdraw or restrict access to services at any time.

17.3 We shall not be liable for any interruption, delay, outage, technical failure or unavailability of services.

 
SECTION 18
 
Limitation of Liability

18.1 Nothing in these Terms shall exclude or limit any liability that cannot be excluded or limited by law.

18.2 To the fullest extent permitted by law, Sublime Timing excludes all liability for indirect, consequential, special or incidental losses arising from the use of our services.

18.3 Sublime Timing shall not be liable for any loss arising from:

(a) event cancellation;

(b) event postponement;

(c) event modification;

(d) participant injury;

(e) participant illness;

(f) participant death;

(g) inaccurate information supplied by an Event Organiser;

(h) technical failures beyond our reasonable control;

(i) third party service failures;

(j) participant failure to comply with event instructions.

18.4 Participants acknowledge that sporting events involve inherent risks and that participation is undertaken at the participant's own risk.

18.5 In relation to any claim arising from the use of our registration, timing or results services, the maximum aggregate liability of Sublime Timing shall not exceed the total amount paid by the participant in relation to the affected entry or transaction.

18.6 Nothing within these Terms shall create any liability on the part of Sublime Timing for the organisation, operation, safety or delivery of an event.

 SECTION 19
 
Event Organiser Responsibility

19.1 Unless expressly stated otherwise, Sublime Timing is not the organiser, promoter or operator of events listed on our platform.

19.2 Event Organisers remain solely responsible for:

(a) planning and organising events;

(b) event safety;

(c) risk assessments;

(d) route design and course measurement;

(e) medical provision;

(f) permits, licences and permissions;

(g) participant eligibility;

(h) event rules;

(i) event delivery and operation;

(j) compliance with applicable laws and regulations.

19.3 Participants acknowledge that any concerns relating to the organisation, operation or safety of an event should be directed to the relevant Event Organiser.

19.4 Sublime Timing accepts no responsibility for decisions made by Event Organisers in relation to their events.

 
SECTION 20
 
Suspension and Termination

20.1 We reserve the right to suspend, restrict or terminate access to our services at any time where reasonably necessary.

20.2 Circumstances in which suspension or termination may occur include:

(a) breach of these Terms;

(b) suspected fraud;

(c) misuse of our services;

(d) unlawful activity;

(e) security concerns;

(f) provision of false or misleading information.

20.3 Suspension or termination shall not affect any rights or obligations accrued prior to such action.

20.4 We reserve the right to remove accounts, entries, content or data where reasonably necessary to protect our services, users, Event Organisers or third parties.

 
SECTION 21
 
Changes to These Terms

21.1 We may update, amend or replace these Terms from time to time.

21.2 Updated Terms shall become effective when published on our website unless otherwise stated.

21.3 Continued use of our services following publication of updated Terms shall constitute acceptance of those updated Terms.

21.4 Participants are encouraged to review these Terms periodically.

 
SECTION 22
 
Governing Law and Jurisdiction

22.1 These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales.

22.2 The parties shall first seek to resolve any dispute through good faith discussions.

22.3 Subject to clause 22.2, the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or the use of our services.

 
SECTION 23
 
General Provisions

23.1 If any provision of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions shall remain in full force and effect.

23.2 Failure by Sublime Timing to enforce any provision of these Terms shall not constitute a waiver of any right or provision.

23.3 These Terms constitute the entire agreement between the participant and Sublime Timing in relation to the use of our services and supersede any previous agreements, understandings or representations relating to their subject matter.

23.4 Nothing within these Terms shall confer any rights upon any third party except where expressly stated.
